The Honorable Edward T. Wahl (Ret.) was a Minnesota trial judge for 14 years. Before his appointment to the bench in 2012, Judge Wahl was a business and commercial litigator for nearly 30 years. Judge Wahl teaches at the National Judicial College, he is a frequent CLE and CJE speaker, and he teaches trial practice at the University of St. Thomas Law School in Minneapolis, Minnesota. Judge Wahl received his B.A. from Northwestern University, his M.A. from the University of Virginia, and his J.D. from the University of Chicago Law School. After 14 years on the bench, Judge Wahl retired in the Spring of 2026. He now serves as a mediator, arbitrator and special master.

Katherine (Kate) Donoghue, Esq. is a tenure track faculty member at Stetson University College of Law. Professor Donoghue teaches Evidence, Jury Selection, and Trial Advocacy and coaches Stetson’s nationally top-ranked Trial Team. Prior to transitioning to academia Professor Donoghue practiced law in New York and Connecticut. Her practice is expert intensive and she hires 1–2 experts per day. Ms. Carpenter is a former ICU nurse. Before founding her firm she defended medical malpractice claims. He will explain and demonstrate how—and how not—to use AI to assist your expert witness practice. She has trained over 1,000 social workers in child abuse investigations and current standards and duties. Chief Justice Brieger will explain the characteristics that effective, credible, and persuasive expert witnesses have in common. She will offer practical suggestions and advice for excelling at direct and cross examination at trial. Questions & Answers

The Honorable Heidi E. Brieger is the Chief Justice of the Massachusetts Trial Court. The Chief Justice partners with the Court Administrator to oversee the administration of the state-wide Trial Court, with its 385 judges, more than 6,500 staff, 94 courthouses and a budget of over one billion dollars. Chief Justice Brieger was appointed to the Superior Court in 2012 and was appointed Chief Justice of that Court in 2021. She was appointed Chief Justice of the Trial Court in 2024. Prior to the bench, she served for 20 years as an Assistant U.S. Attorney in the District of Massachusetts, and for five years as the Chief of the Organized Crime Drug Enforcement Task Force. She was a law clerk to the Honorable Andrew A. Caffrey, Chief United States District Judge for the District of Massachusetts and later practiced in the litigation department at Hale and Dorr (now WilmerHale). Chief Justice Brieger is a graduate of Smith College and Boston College Law School and is on the faculty of Boston University School of Law.

Attorney Barber will explain and demonstrate how experts can be more effective during cross-examination. Included will be a discussion of some of the difficult questions and cross-examination tactics that expert witnesses should be prepared for. Questions & Answers

David Barber, Esq. is a trial lawyer whose practice focuses on negligent security and other preventable crime cases, as well as injuries caused by unsafe service of alcohol (dram shop liability). He has tried more than 120 cases to juries and has represented clients across the country and the U.S. Virgin Islands through numerous pro hac vice admissions. He is particularly known for cases involving negligent security at bars, restaurants, hotels, apartment complexes, and entertainment venues, and for alcohol-related liability where overservice or policy failures lead to catastrophic harm. In 2022, he obtained a $19+ million verdict in a case involving negligent security and dram shop liability. Attorney Barber is a frequent public speaker. He received his BA in communications from the University of Louisville, his MA in Speech Communication from the University of Illinois and his JD from the Louis D. Brandeis School of Law–University of Louisville.

Mr. Ratliff will provide advice and suggestions for how to analyze and evaluate opposing expert’s opinions. Alan Ratliff, JD, CPA, CFF, CGMA, CPVA is a Partner at Stoneturn, an international advisory firm and a Province Company. Alan advises attorneys and their clients on economics, accounting and valuation issues in disputes and investigations, as well as in various transactions including the valuation, commercialization, and licensing of intellectual assets and businesses. Alan has consistently been recognized as one of the two dozen most “Highly Recommended” economic experts based on client and peer surveys in IAM’s Patent 1000. He has testified as an expert witness more than 200 times and has authored over 300 Expert Witness Reports. Dr. Meihls will provide practical pointers for expert witnesses looking to improve their performance at deposition and trial. She will emphasize tips that can “move the dial” and make the expert more effective. Dr. Meihls will share some of the conclusions from the extensive research/data analysis she and her team has conducted from jurors as to what works and what does not work in terms of expert testimony. In addition, she will share what she looks for (and what she avoids) when interviewing experts to potentially serve on the high profile/high stakes cases on which she is commonly retained. J. Lee Meihls, Ph.D. is the President of Trial Partners, LLC. She has over 40 years experience in litigation consulting including numerous high profile and bet the company cases such as, People v. Dodgers and Frank McCourt (for the Dodgers and Frank McCourt).
